1) Which will only hold up in court if applied even-handedly to all religious institutions, not just mosques.

2) Which will only hold up in court if not used to limit free speech -- advocating criminal acts is subject to the "clear and present danger" test -- is there a clear and present danger that a crime will be committed as a result of the advocacy?

It's already illegal to advocate criminal acts if there is a clear and present danger that they will be committed. If not, it's not illegal and can't be made illegal without violating the First Amendment.
