Again, you make a very good point {if in somewhat broken english}. You seem to realize something that the FBN BSB'ers either do not recognize, or want badly to deny.

This is a matter called 'specific performance.' It is usually applied to cases where the performance of an action (in this case, return of the stock) would provide the relief sought by the plaintiff and that a monetary amount, such as the amount involved in the breach would not provide.

The possible scenario is not far fetched ... it is probably just misapplied as there should be little probability of that occuring.
