The failure of the process to detect the 9/11 scum was designed in by clinton and company. When flaws are designed in a process, only later defects will usually surface them. In addition to all the wasted time caused by gore's foolish dishonesty, there was also the hate delay in congress of appointments of good men who might have caught the flaws.

In liability, the fault lies with the designer if the design created risk for the sake of some correct form.
