You couldn't have it both ways, no gain then zero cost basis. The profit has to show up somewhere.

In the US, you will be taxed on the cost basis for the shares you are selling. This whole game is more like overwithholding on your taxes so you are sure to get a refund at the end of the year. Maybe not optimal for profits but designed to overcome the natural human desire to make stupid financial decisions most of the time - like buying and selling good companies too often.
