If your closing bid price is below 1 dollar for a full month you are in violation the first time this happens you get 3 months to "cure" the situation by having your bid price stay above 1 dollar for 10 coinsecutive trading days. Then each month your stock needs ot be above 1 dollar for at least 1 day (closing bid price)

However there is an appeal process which can tale 30 days.

So............ 1 month to be in violation + 3 months to cure + 1 month to appleal is effectively 5 months...

We are probably looking to be ok untl mid January. By then I woul hope that the 9032, Gigabit Etehrnet and the Nortel alliance will ahve enouhg strength to hoist the stock back into the 3's leaving NASDAQ delisting a long distant memory.
