Why doesn't the money coming in to pay Clinton's legal defense count as income?

They were very clever this time setting up the fund. The first time I think they limited the donations to $500, but this time it's all the way up to $10,000, which just happens to be the limit for being excluded from taxes as a tax free gift per individual.
