One of the problems EBAY is facing is fraudulent use of their service-thus the new policies. Even though they have a disclaimer they can still be held liable. It's like when you participate in an athletic event. You sign a waiver, but if the promoter is negligent the waiver means nothing. Would a "reasonable person" check out a purveyor of $10,000 items before allowing them to be sold on their site?
