It could be semantics, but to me, to be "in play" a pattern has to be complete and making a prediction.

H&S patterns don't become predictive until they break the neckline and more predictive if done with volume.

The one you showed is a "POTENTIAL H&S top pattern."

Until the neckline breaks, flipping a coin is just as predictive. It could make a higher high with less of a move than what it would take to fall and break the neckline.
