You are right. Pieces would be greater. However if they lose the case, I don't think the government wants to break up Microsoft. Instead they want to put a lot of restrictions on them. The DOJ is just after the browser business at this point. It would have to be another case if they want a breakup.

If I was Bill Gates, I would make sure that MSFT maintains the largest capitalization in the S and P 500. Index fund's top holding would be MSFT--Index funds are getting more popular form of investment due to the better returns. Investors will see MSFT at the top of the list and won't like it if the government takes action. This equals more support among the masses especially middle class.
I noticed that MSFT has already posted on their website about contacting the policitians. Lobbying and public relations are key for this company in the future. The current anti-trust is not a big deal. They should be ensuring future cases don't arise.
