Well, I don't think we need a constitutional amendment because I don't think it would receive the 3/4 ratification among the individuals states. And it would only be self-defeating for conservatives... Preserving the woman's right to an abortion under Roe v Wade is one thing... You misunderstand my point. I wasn't arguing for a constitutional amendment banning abortion. (Although I would not have a problem with one), I was rather asserting that since the constitution says nothing about abortion then there is no constitutional right to an abortion, and that if one was to be created it would take a constitutional amendment. Of course in practice if the court says something is a constitutional right then it doesn't really matter if the constitution says nothing about it, but there job properly is to interpret what is actually in the constitution, not imagine that the constitution says what they want it to say, and effectively create law based on that imagination. If we to actually follow the constitution abortion would not be a federal issue, but instead one for the states. Tim
