I think technically, you will find that the presence or absence of price protection is irrelevant. The proper determination of a sale is dependent on whether it more proper to treat the distributor or who ever as an "agent" of the seller or an independent buyer or an agent of an independent buyer. If there is a price protection scheme, that would be dealt with as a reserve or reduction in the AMOUNT of what is "sold", not whether or not a sale occurred.
