VIA is SIII's successor in interest for the SIII patents and the assignee of those intellectual property rights. Intel has had to acknowledge, as the result of lawsuits, that the SIII/VIA patents cover various aspects of its microprocessors.

Will VIA argue that Intel's suit breaks the cross-license agreement and seek an injunction against Intel shipping chips that violate VIA's patents?

The game can be played both ways. The issue of whether or not VIA's patents cover Intel's processors has already been settled in court. Having screwed up big time on the whole Rambus patent deal is Intel about to do it again?

What if Intel comes out of this having to pay VIA 4% of the revenue it receives for every microprocessor it ships?
