That may have been DELL's excuse then, but those most assuredly could have warned. A 'quiet period' in this case is company imposed, and a company is still obligated to disclose information that would have an impact upon the stock price as soon as this information is available; it doesn't matter when this news is received. The period is more related to general company comments to investors and analysts. DELL won't make comments around earnings as a practice so as not to give anyone of firm an advantage.

This goes back to an older problem of DELL's; bad news at DELL tends to be poorly received, and thus bad news is often 'swept under the table' until the problem grows. There hasn't been a whole heck of a lot of bad news lately at DELL, so a lot of people have begun to forget this issue.
