I agree with you, Jeff. When I read Art's post, I was tempted to comment, but chose not to. Did a bit of research into Q's last 10-Q to see that its SG&A was up $160MM over last 10-Q, of which $29MM was attributed to increased legal expenses. That translates to about $.01-.02 EPS.

But the impact on earnings does not have to do with the nominal legal expense figure, but an unexpected increase in the legal expenses. I can't see how the market is going to be surprised by Q's legal fees @ this juncture. And even if it were unexpected, it's a non-recurring expense, that should not have any measurable impact on the company's prospects going forward.

It's the OUTCOME of the litigation, whether it be in the form of court's or commission's ruling, or a negotiated settlement with the complaining parties, that will have a much greater impact upon the earnings picture going forward.
