Because they have a different method of affirmitive determination. They will let you short the stock first, and do a locate later. If they don't come up with a locate by settlement, you get bought in. The folks I know who trade in Canada get bought in a lot. But these are bokerage rules, not laws.

It may be next to impossible to short a particular name through a US brokerage, but I can enter into a private contract with anyone who owns a stock to borrow their shares, and deposit them into my account and sell them. My broker may not be willing to facilitate the borrow, but I'm not going to be hauled off to jail for shorting a stock.

Yes, there is lots of bad information out there, and people who swear it is fact.
