An added issue with your argument Qurious is what to do about the patents that help the performance of the SEP patents but are not SEP. Thus if one has a royalty built into the IC, it would not include the interactive performance building patents. The benefit of a license on the whole bundle is that all users get access to all the SEP and the non-SEP performance enhancing patents for one set price. This may not have been as much the case with TXN when the SEP may have comprised most of the peripheral patents that would help performance that were non SEP.
