Toxic chemical weapons (e.g. nerve gas) are considered weapons of mass destruction. Also nuclear and germ weapons are WMD.

Hence someone can use a WMD and kill 5,000 Kurds or 100,000 in a major city. It is still a use of WMD.

If you nuke a remote town in Nevada and kill 500 people, you are using a weapon of mass destruction.

The importance is not how many you kill but on how dangerous you are as demonstrated by the weapons you possess and your willingness to use those weapons.

Saddam had WMD and used them against thousands. Hence, he was a very dangerous man and had very dangerous weapons. Furthermore, he wanted even more dangerous weapons and behaved as if he had more of them. That was the justification for his removal.

Lesson for other dictators:
If you get rid of your WMD, then do not be stupid enough to pretend you still have them (eg. kicking out UN inspectors). If Saddam never kicked out the UN inspectors in 1998, then he would still be in charge and still be having fun torturing Iraqi citizens.
