I think the legal process is very clear on this. Only those who "settle" with AOL under the terms negotiated with the AG's are ineligible to participate in the class action. That will still leave some awfully angry subscribers. It is in AOL's best interest to get subs to agree to the terms of the AG settlement. Those of you who are subs, should recognize that if you accept AOL's "freebies" or rebates, you have probably effectively opted out of the class action. I admit that I am not a lawyer (thank God for little things), but I think this is how it works.
