Not a poor strategy at all considering the lack of gumption in management. My point was that usually you have to establish a legal duty is owed to someone before you can recover against them. Since Naxos had no duty to us individual shareholders and the contract was with Naxos (assuming there is some type of contract the threshold question and first line of defense is what is the duty owed to the shareholders? JLA
