With regards to inalienable rights, the author Thomas Jefferson stated "That among these are ..." The word 'among' has always caught my eye. Most people read the statement as "The inalienable rights are ..." as if it were a closed statement, but it is not. There are many natural rights associated with being human. For example, we have a right to live according to our conscience. This isn't specifically stated but we've managed to wrap the freedom of religion and freedom of speech around this concept when the issue has come up in the past.

The statements in the constitution regarding rights have been included so as to protect our rights not to grant them. The granting is assumed at birth and by the statement 'Endowed by their creator' and the term 'inalienable'. They need protection because individuals and society at large is harmed when human rights are not protected. Personally I think there should be more protections specifically stated and I bet if Jefferson had lived up to now quite a few more human rights amendments would have been considered. I also think protection of the rights of other creatures and the Earth should be included. JMO

Bottom line on your comment is that we wouldn't have human rights protections if harm were not an issue. The DOI and the Constitution aren't just a bunch of flowery words ya know.
