I don't remember the figure, but a startlingly high percentage of those now executed are mentally retarded. (I assume that in every case, their retardation was raised as a mitigating circumstances, but if a crime is horrendous enough, I'm not sure that helps; it might even hurt, is my intuition, for which I have no supporting evidence.)

It'll save the taxpayers money not to have those expensive capital trials and appeals and death row accommodations for them, but just to toss them in prison for the rest of their natural lives. Surprisingly, the latter is cheaper. If it was legal to kill them, the death penalty had to be asked for, in ugly murder cases, because of public demand.

This way the DA won't get into trouble when he or she doesn't do that: "He's mentally retarded, it would be unconstitutional."
