They often are.

It is often then pointed out by the prosecution that the person who took drugs, or got drunk, while carrying a gun or driving a fast car, knew at the point they chose to become impaired, that they would soon be impaired, and chose, knowingly, that condition.

Children, mental or chronological, don't choose that state at any point.
