I meant less legitimate. If you recall the discussion was on criminal death penalty with killing during a war being just an example of a justified state killing. Wars, especially successful wars cause decision makers to think of war again as a tool to further the country's interest.

That is exactly the kind of behavior we would want to avoid in the criminal death penalty. The goal is to make the events which lead to it's imposition less likely. The death penalty's supposed deterrent effect is lost if it becomes rare and not constantly in the mind of potential criminals (otherwise only impulsive criminals would commit the kind of crime involved and they are not deterred). The goal of the death industry then becomes giving just enough chance for the criminal to escape the punishment to keep the process functioning. If you look around you will see that the expected process is in fact the one we have. As I said, it's really pretty sick.
