Libs New Tack On Alito

Michael Barone of US News and World Report and Eleanor Clift of Newsweek were on Fox today. Each said Democrats do not have the votes to filibuster Sam Alito's nomination. They follow the lead of Bob Byrd.

But what is new is Clift outlining the new Democratic tack in opposing any and all Republican nominees to the Supreme Court: How often has the nominee ruled in favor of the executive branch.

Well, at least the libs are learning. No one cares about abortion. Really, truly, we don't care. Overturn Roe v. Wade? Fine. We'll just legalize it anyway.

But the new tack of judging how often the judge rules in favor of the executive branch does not make a whole lot of sense. The Washington Post left me confused when it tried to trot out this new line in an editorial on Saturday:

"The most striking of these is the unusual deference he tends to show both to executive branch agencies at the state and federal levels and to the lower federal courts in their role as the judiciary's fact-finders."

Oh goodness, we cannot have that. We cannot have judges accepting the facts as found in lower courts. We need judges, the Post seems to argue, who just throw out the work of the lower courts and the executive branches at the state and federal levels.

In short, Alito is not buying into the Imperial Judiciary.

Which makes him the perfect candidate for the Supreme Court. He seems to share with John Roberts and Clarence Thomas the humility that the job requires.

I doubt this new tack will have much traction. But I thank libs for looking for something other than this stupid abortion debate.
