Apparently, this is no longer acceptable in America. I guess it's a good thing that James Madison and Thomas Jefferson, founders of the party that eventually became today's Democratic Party, aren't around today to see the Democrats throw hissy fits because someone thinks that powers not mentioned in the Constitution are reserved to the states. You know, that whole 10th Amendment thing. Perhaps, Alito can remind the Senate Judiciary Committee of these words, penned by James Madison.

    The powers not delegated to the United States by the 
Constitution, nor prohibited by it to the States, are
reserved to the States respectively, or to the people.
