In that case, they found a win-win for this particular question almost 60 years ago and it didn't stop a kook from filing the lawsuit, did it now?

Let's see:

The Pledge of Allegiance cannot be made mandatory in schools.
The Pledge of Allegiance may be recited any way a student wishes, or not at all.

Only people who resemble those looking under beds for Communists can seriously believe that this is state-sponsored coercion.
