We all knew that with the White House and Congress in the hands of folks who'd
like lifetime appointments to the federal courts to represent their narrow special
interests, we'd be in for a few bad judicial nominations. We just didn't think
it would be this bad, this fast. But the national focus on the possibility of
America attacking Iraq seemed like the perfect time for those who would pack the
courts to sneak the first one by us.

Bush and his allies in the Senate are trying to push through the confirmation
of Miguel Estrada for the D.C. Court of Appeals, the second most important court
in the nation. Opposition to his anti-civil liberty/pro-corporate ideology is
coming from many quarters including The Congressional Hispanic Caucus, labor unions,
and People for the American Way. He refused to answer even the most basic questions
about his views during a Senate Judiciary Committee hearing, and his nomination
was only able to move forward because of a party-line vote. (Favorite unanswered
question: "Can you name ONE Supreme Court ruling in the last 50 years you disagree
with?")

Now fearing the gathering storm opposing his nomination, the Senate Leaders
have scheduled the vote on his nomination for the same day Colin Powell will be
speaking about Iraq at the United Nations. That way they hope that the media
and the public will be too distracted to notice what they are doing. Don't let

Dear Senator:

I write as a constituent of yours to urge you to support a filibuster opposing
the nomination of Miguel Estrada to the D.C. Court of Appeals. His views on civil
liberties, the power of corporations, and other important matters are too extreme
for our courts.

During his nomination hearing Mr. Estrada refused to answer even the most basic
questions about his judicial philosophy thus preventing the Senate from fulfilling
it's constitutional role to advise and consent. On these grounds alone you should
oppose this nomination whether you agree with his apparent judicial philosophy
or not.

Thank you for your consideration of this crucial matter.
