There are now three issues for trial: 1. Are SNDK's patents overbroad? 2. Did SNDK have an unwritten agreement to disclose its pending patent application at the time the standards committees were meeting and, if so, did LEXR reasonably rely on this to their detriment? 3. Is SNDK engaging in patent abuse by requiring its licensees to license SNDK's entire patent portfolio and to purchase the underlying flash used in the cards from specified vendors in exchange for SNDK agreeing to license the patent at issue?
