No, it's time for SNDK to conserve its cash and use whatever is needed to fight Lexar. Not that Lexar is the cause of the present weakness in SNDK, but, apart from producing good quality products, building new plants, and staying up with the growing demand, job #1 is to perservere against Lexar until the matter is resolved in favor of SNDK.

A favorite tactic of many who use the court system for private advantage is to wear down the opposition in order to gain by default what they can't through their own research and management skills. Too often, organizations fold under these constant assaults, figuring it's too much money and trouble to pursue them. This case is a little different in that a whole new company apparently was started by a renegade former SanDisk employee who, for whatever reason, holds a grudge against his former employer. This fact raises an issue of credibility that will be hard for Lexar to deal with at a trial. So let's wish SNDK well at trial and let the chips fall where they may (no pun intended).
