There are lots of unexperienced cops running around on a Friday night trying to keep up with everybody who is looking for any kind of excitement they can find. Sometimes they take a quick look at a situation, make an arrest, and file some related charges. The stories behind the arrest episode are often times very rich and complicated. The lawyers wade in to stake out a position. Plea bargains are the rule not the exception. Chances are no body is totally innocent but in many situations where all hell is breaking loose, the young cop could have flipped a coin to make a decision on who to cuff. Some times they get snowed by their first impression on the scene. Who ever has the best story wins the day. Often times people are charged with several crimes simply because it is a requirement for the cop to do so. The cop may have been duped by somebody at the scene and the wrong guy was drug off. Doesn't matter, its in the DA's hands now and the DA doesn't get ahead by being easy to get along with, nor does he have resources to investigate anything short of Murder one. Few citizens have the funds to afford lengthy criminal trials and the Judges don't have time to try anything short class 1 felonies. So plea bargain is what everybody does. The DA gets credit for something and its not as bad for the defendants as it could be if there were no bargains. The crime they are punished for is irrelevant otherwise.
