You can always start a court challenge if you the $$ for a filing fee. You may not win but you can start the challenge.

In the case of Carnahan's widow the R's are asserting 2 things. First, that a dead man is not an "inhabitant" and therefore is not eligible to run for senator. Second, the statement by the governor that 'if you vote for Carnahan, I will appoint his widow' is some kind of vote buying scheme in violation of the law.

The R's in the senate are making noises that they may not seat Carnahan's widow on the grounds that they are in the majority and can do whatever they want to determine whether a newly elected senator should be seated. The moderate R's are very unlikely to allow this to happen.
