congress would see to that How? Remember they are structuring the deals. They can arrange them so that they fit whatever category congress creates that has a lower tax rate. Well congress could just not give capital gains a lower rate but raising the capital gains rate would reduce and distort investment, and besides there would probably be some loopholes they could find. Congress could greatly simplify taxes getting rid of just about every loophole, but they've never done that before and haven't even headed in that direction since the 80s, so it doesn't seem likely.
