Backfiring is a legitimate technique for fire fighting, although I'm not sure what the brothers did really qualifies. Backfiring usually implies that the backfire is being drawn toward the main fire by the winds the fire creates by sucking up air. The backfire is intended to separate the fire from potential fuels, thus removing one of the three sides of the fire triangle: fuel, heat, and air.

Those guys looked like they had nomex shirts on, so they might have some experience to draw from. Back firing is not to be done lightly, or without adequate knowledge of how it works.

I think the legal eagles should practice a little common sense here and let the guys off with a warning, or if circumstances warrant, accolades.
