<If their product is indeed technologically superior and remains so, then they'll win anyways.>

Since when does technological superiority win out in desktop software battles?

Technological superiority is a powerful tool in winning out, although not the only one. But don't you agree that the customer wins if MSFT is enjoined from illegally leveraging their monopoly to win because it forces MSFT to rely more on innovation. Moreover, DOJ action could help to allow innovative competitors to remain alive to guard against MSFT gouging customers in the future.

Not that I think that the current action will have any of these effects. I kind of agree with Dan that this action will not amount to a hill of beans. But the DOJ case does not have to be won for it to be at least partially successful. It may help raise awareness in the public (as I think that it already has) that MSFT is not as pure as the driven snow as they think. It may also help to keep MSFT from being even more egregious in their illegal monopoly-leveraging conduct.
