Sounds to me like a good delay tactic. I think T.K. has the upper hand in the arbitration case but is feeling the heat in RICO. T.K. knows it is going to lose RICO just as Microsoft is going to lose its anti-trust trial and is attempting to stall RICO as long as possible to force LONE into lifelessness by the arbitration suit, ie. using every tactic in the book and then some to delay/avoid providing its trading records, or hoping that it can win a battle of resource attrition and force LONE into bankruptcy defending itself. T.K. hopes to kill LONE through arbitration to stop the RICO case. LONE's response is to delay, delay, and delay the arbitration in the hopes that RICO will advance and force T.K. into a settlement. Any conclusion in RICO would help arbitration. Each is trying to press one front while delaying on the other.
