Please refer to page 83 of the August 4, 2000 proxy statement under the heading, 'License Agreements'. The patent to which you refer is included among the patents addressed by this section. The non-competition provision in the Microsoft Commercial Alliance Agreement generally prohibits Microsoft from using these patents, or licensing these patents to others, in conflict with the non-compete provisions. The license granted is royalty-free.

Unfortunately after reading the text on page 83 we don't have an exclusive as it intimates in the message above. I'm inclined to give more credence to the Proxy.

"With respect to patents, we will have a similar license, except the license will be non-exclusive."
