Yes, Jefferson could raise the constitutional issue in a Motion to Suppress, if and when he's charged.

I don't see why the rest of Congress has to wait for that.

I'm disappointed, but not surprised, that others don't recognize that if the shoe were on the other foot, Congress couldn't send their own police to rifle through Bush's private office in order to bolster a potential impeachment trial.

The fact that you, a lawyer, don't seem to respect Congress as a co-equal branch of government surprises me.
