If you attempt to speculate in court, opposing counsel will object "speculation, your Honor," or "no facts in evidence, your Honor," and the judge will say, "sustained." Keep doing it and you're risking a citation for contempt of court.

Argument must be based on facts presented with certainty, not speculation.

Pre-emptivity is what war is all about

I think you're mistaken. It's true that throughout history, nations have attacked other nations -- Japan attacked the US at Pearl Harbor pre-emptively, Hitler attacked Russia pre-emptively. This is not considered a good thing.

It's a violation of the law of war. We (America) have never done it before.

The administration claimed that "9/11 changed everything" and we had to attack Iraq before Iraq attacked us first, using WMD, because the consequences of waiting would be dire.
