The counsel for the losing side files an appeal of the Appeals Court decision (the three-judge decision) asking the entire court to reconsider it. The Circuit Court then votes on whether to hear the case en banc. I'm not sure what the reasons are for doing that rather then taking the appeal directly to the Supreme Court, but there is that possible step in between.
