I think, I think, although I am not sure, that "hard cases" are cases where the Court feels pity for one of the litigant, and the ruling is one which is contrived so as to give the poor litigant a break, and the stare decisis effects for others turn out to be horrendous, as people whose circumstances are not so compelling distort their cases to try to fit within the ruling.
