I don't think it really matters how the UN defines torture, what matters is how we define torture, that is to say, the US government.

For that, take a look at the infamous "torture memo", written by Alberto Gonzales, Attorney General. This is straight from the Department of Justice, not at all hard to read.

Both memos are intended to show how far treatment can go before it crosses the line -- "pain" is OK, "excruciating pain" is not OK, and what's in between?
