Microsoft Subpoenas Netscape, AOL, Others for Trial, WSJ Says


Redmond, Washington, March 12 (Bloomberg) -- Microsoft Corp., the world's largest software maker, subpoenaed America Online Inc., Netscape Communications Corp., Goldman, Sachs & Co. Morgan Stanley Dean Witter & Co. and Sun Microsystems Inc. as part of its antitrust trial, the Wall Street Journal said. Goldman Sachs advised AOL in the transaction, while Morgan Stanley advised Netscape, and Microsoft likely will use subpoenaed documents to show the merger of AOL and Netscape poses a major threat to its Windows software. Only closely held Kleiner Perkins Caufield, a California venture-capital company, refused to comply with the subpoenas, according to an unnamed Microsoft spokesman, and Kleiner Perkins wouldn't comment, the Journal said.

Microsoft in-house attorney David Heiner on March 3 sent Chairman Bill Gates and other executives an e-mail saying the company's witnesses and evidence effectively have disputed the government's allegations of illegal behavior. (WSJ 3/12 B5 wsj.com)
