Tribe is a constitutional scholar who will use his vast legal knowledge to arrive at the opinion he wants. I'm using my meager (in comparison to Tribe's) legal constitutional knowledge to arrive at the opinion I want. By no means though is either one of us definitive despite our learning gap/expertise on the subject. That shall remain for the judges on whose docket the case lands.

The maxim that I stated about courts generally deferring to legislative bodies as to how they conduct themselves still stands IMHO (as long as those legislative bodies by those rules are not trampling on an individual's basic liberties guaranteed by the amendments.)

Obama did this, IMHO, as a political ploy seeking to enhance his electability. Whether this act actually accrues to his benefit we shall have to see. As I said before if his appointee acts in a way that turns out to be invalid the legal and political damage from such could be extensive.

But let the lawsuits begin.
