Dan brought up some concerns.
He's bearish on the stock, admits that.
So he finds/looks for/finds negatives.
Fair enough.

re: M.Mulshine.
From my perspective, he showed enthusiasm -- perhaps too much.
He did tell me the earnings would be out sooner -- perhaps he was ill-informed.
He has corrected mis-information -- to his credit.
And I made a bad joke in calling him, "Moonshine."
And he can't enter this discussion during this "Quite time."

As for getting the code thru litigation, I couldn't care less.
Companies have created success stories on less.
And the S-3? This sounds fishy. I didn't know government docs could be withdrawn. So I question that. But S3s are just "registration" documents, aren't they. Insiders always "have to" register them for them to become "negotiable instruments" -- It doesn't mean the holders "Will" sell, just that they "CAN" sell.

re: lawsuits.
I don't think I have any 10k's for the companies that I own that doesn't have lawsuits pending. That's no surpirse. And evaluating them is beyond my abilities.

"Apple Polisher"?
Yeah, perhaps. But so was/Is Iomega. (and before the 6-for-1 splits).
So, that's not necessarily a bad thing either. "If ya got it flaunt it" (but of course they need to follow thru).

Dilution:
Unfortunately, yes.
But to what extent? I don't have the figures by me.
But "Capitalizing" debt is not necessarily a bad thing either. It means the debt does not have to be repaid.

Revenue & Earnings?
Yes. No sustainable long-term growth until those are behind us.
But there are three phases of a bull market stock.
1.) Those who buy on "hope" and anticipation.
2.) Those who see the turn-around and buy momentium.
3.) The value players who "Buy" the numbers after they are proven.
(& the time-span can be years to decades)
In my opinion, anyone long "HAS" to be in the first group. And of course this is where the Risk, as well as Return potential is high.

Tangent disappointment?
A valid concern.
I know not what those numbers will be.
But I guarantee you that I wouldn't have bought the company for this division. Unimpressive at best.

Catapillar Salesman?
I haven't checked his credintials... but:
Probably a guy with a lot of contacts in the field (and this already addressed in another's post).

The best we could hope for?
In my opinion, a change at the top, as has been anticipated here.
