There was absolutely some shared responsibility by the two drivers. One boat was traveling at 2-3 mph and the other at 40-45 in the dark. The prosecution reduced their recommendation down to 5 1/2 years because of the circumstances. The judge decided that Melissa's death was only worth 2.5 years.
