The answer is simple. Make marriage a purely religious device, with no legal standing, and make the legal part a Civil contract. You could include pre-contract negotiations and some form of recompense for the years of labour, a stay at home mom does, and provide for all the legal solutions for any dissolution of the Civil Contract. Let any two people have one, so that an elderly parent could get the same help living with a single child that a spouse does, if both parties agree. The Religious Status could be determined by the church or temple or whatever, but would have only religious significance.
