Pretty stupid move on the part of the Phishers, IMO. IRS has it's own criminal investigative division. I suspect they take this kind of thing more seriously than, say, Bank of America would. Someone gets caught doing this tax refund scam, they can expect to be doing time as a guest of the Fed. government.
