Dear Jens - it depends on who are the "we". Vulture investing is best positioned on the debt side [note: just in case I am misunderstood, even though I trust that you and I have known each other long enough here that you don't doubt about my authenticity, I only invest long on common - never short, never options, and never debt.] My suspicion is that HDS mgt is more concerned of the raiders on the debt side [and not equity side.] I do not know the ulterior motives. Maybe the current mgt has a stake of which outsiders don't know. Maybe its concerns for the employees are genuine. Maybe this is indeed the best deal it can come up with for all the parties involved - so it is better to have something than nothing. Maybe the Chairman feels adamant that he will not be the one taking the company a second trip to Chapter 11 on his watch. Self-respect can do funny thing to people [of course, if that happens, his chairmanship will be lost for sure.] I don't know enough of the players involved to speak for or against them.
