Barron, I can only speculate that the fuel cell engines "may" not qualify due to the fuel that is powering the fuel cell. If it is anything other than hydrogen, some pollutants will be created/released in the reformation to hydrogen from methanol, gasoline, etc. I think any fuel other than hydrogen will be temporary until the infrastructure to safely handle hydrogen is in place. That is why regulators may give the fuel cell a break, in order to get acceptance of the technology.

Besides, anyone who realizes that battery powered vehicles are non-polluting live in fairy land. All you do is move the creation of pollutants to power plants; the benefit of course, is that these are usually in rural areas and would at least reduce the congestion in urban areas. I submit that this would be bad news for clean alternatives, like fuel cells, as it would reduce the visibility (pun intended for those in LA or Mexico City) of pollutants in the publics' mind.

Anyways, I am at odds to explain the recent run up in share price. Would I buy now??? Not sure....
