I have a question to the ZICA gang regarding foreign investment rules in China ?
Can a Chinese based internet services provider or content producer raise capital from outside China and still continue to do business under the current Chinese government regulations ?
From the following lengthy report I take it that all investments in China can be super risky based on the government ability to shut you down because of foreign investment rules.
According to Wu Jichuan, Minister of China?s Ministry of Information Industry (MII)......
As Chinese media reported, Wu was careful to differentiate telecom service from telecom equipment manufacturing, because foreign firms still have unfettered access to the latter in China; the Internet/Telecom policy debate does not affect telecom equipment manufacturers, nor those engaged in research and development. In his statement, Wu cited the following excerpts from a 1993 Chinese regulation that identifies Telecom services as off-limits to foreign investors: "No work units may operate telecom services without the inspection and approval of the MPT and the regional postal and telecom regulatory bureaus (collectively referred to as supervisory departments of communications (SDC) hereafter). Foreign individuals and organizations, along with foreign invested or partnered enterprises that have been already established in China are forbidden from investing or either solely or cooperatively operating in telecom services in China." (PRC Interim Provisions on the Approval and Regulations of Businesses Engaging in Telecommunications Services, September 11, 1993) Moreover, article 7 of "Projects that Are Prohibited by Foreign Investment," which was taken from the "Catalogue For The Guidance Of Foreign Investment Industries," promulgated by Decree No. 5 of the State Planning Commission, the State Economic and Trade Commission and the Ministry of Foreign Trade and Economic Cooperation on June 20, 1995, states that the Post, Telecommunication and Transportation Industries, specifically the management and administration of postal and telecommunications services are also prohibited. When these statements were originally announced, there was no Internet community to react to them. Since then, China?s Internet industry has flourished, and now widespread attention is paid to any relevant policy statements.
